Terms of Service
Agreement and accounts
These Terms are a contract between you and Danny Porter & Co LLC, a Washington limited liability company ("Plumbline," "we," "us"), for your use of the Plumbline website at plumblineplanner.com, web app and any related mobile apps (the "Service"). By creating an account or using the Service, you agree to these Terms and our Privacy Policy. If you don't agree, don't use the Service.
Eligibility. You must be at least 13 years old, and if you are under the age of majority where you live, you need a parent or guardian's permission.
Your account. Give us accurate information and keep your sign-in details secure. You are responsible for activity under your account. Tell us right away at danny@plumblineplanner.com if you think someone else has accessed it.
Subscriptions and billing
Plumbline is offered as a paid subscription, billed monthly or annually, with the plans and prices shown at checkout.
- Free trial. New subscribers get a 14-day free trial. No payment method is required to start. When the trial ends, choose a plan to keep using Plumbline; we won't charge you unless you do. One trial per person.
- Automatic renewal. Your subscription renews at the end of each billing period at the then-current price until you cancel. We will tell you in advance of any price change, and you can cancel before it takes effect.
- Cancellation. Cancel anytime in your account settings, or through the App Store or Google Play if you subscribed there. Cancellation stops future renewals; you keep access until the end of the period you paid for.
- Refunds. Payments are non-refundable except where the law requires otherwise. Purchases made through Apple or Google follow their refund policies.
- Founding member pricing. Founding member discounts apply to annual plans as described at signup, carry over to the AI plan upgrade, and continue for as long as your subscription stays active without a lapse.
- Taxes. Prices exclude applicable sales tax, which we collect where required.
Payments are processed by Stripe. By subscribing, you authorize us to charge your payment method for each renewal.
Your content and acceptable use
Your content is yours. You own the goals, plans, notes and other content you put into Plumbline. You give us a limited license to store, process and display it only as needed to run the Service for you, including sending it to our service providers. That license ends when you delete the content or your account, except for copies in routine backups.
Acceptable use. You agree not to:
- Break the law or infringe anyone's rights while using the Service
- Try to access other users' accounts or data, or our systems without permission
- Reverse engineer, scrape, overload or disrupt the Service
- Upload malware or use the Service to send spam
- Resell or share access to your subscription outside what your plan allows
AI features. AI-generated suggestions may be inaccurate or incomplete. Review them before relying on them; you are responsible for how you use them.
Our property. Plumbline, its software, design, logo and branding belong to us and are protected by intellectual property laws. We give you a personal, non-transferable, revocable license to use the Service under these Terms. If you send us feedback or ideas, we may use them without owing you anything.
Disclaimers and liability
No professional advice. Plumbline is a planning and productivity tool. It does not provide medical, mental-health, financial, legal or other professional advice, and it is not a substitute for it.
Disclaimer. THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT THE LAW ALLOWS, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. We don't promise the Service will be uninterrupted, error-free, or that your content will never be lost, so keep your own copies of anything important.
Limitation of liability. TO THE FULLEST EXTENT THE LAW ALLOWS, PLUMBLINE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR $50. Some places don't allow these limits, so they may not fully apply to you.
Indemnity. You agree to defend and hold harmless Plumbline from claims arising from your misuse of the Service or your breach of these Terms.
Termination, disputes and changes
Ending your account. You can delete your account anytime in settings. We may suspend or end your access if you seriously or repeatedly break these Terms, or if we must for legal reasons. If we discontinue the Service entirely, we will give you at least 30 days' notice and a way to export your content, and refund any prepaid unused time.
Governing law. Washington State law governs these Terms, without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts in Spokane County, Washington, and you and we consent to their jurisdiction. Either of us may bring a qualifying claim in small claims court. Before filing a claim, please contact us so we can try to resolve it informally.
Changes to these Terms. We may update these Terms. We will post the new version with a new effective date and email you before material changes take effect. Continuing to use the Service after that means you accept the updated Terms.
General. If any part of these Terms is unenforceable, the rest stays in effect. Our not enforcing a provision is not a waiver. You may not transfer these Terms without our consent; we may transfer them in a merger, acquisition or sale of assets. These Terms and our Privacy Policy are the entire agreement between us about the Service.
